Terms of Service

This website (the Site) is owned and operated by Success Property Ventures Pty Ltd, trading as Property With PK (Property With PK, we, us or our).

These Terms of Use and Conditions (Terms) apply to your use of the Site and to your purchase of, enrolment in and participation in the Property Renovation Accelerator (PRA or the Program), including its training, mentoring, online community, tools, templates, recordings, documents and other resources.

By accessing the Site, enrolling in or paying for the Program, or logging into the Program platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Site or participate in the Program.

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase the Program. If a person under 18 accesses any part of the Site, they must do so with the permission and supervision of a parent or legal guardian.

We may update these Terms from time to time. Any updated Terms will be published on the Site and will apply from the date stated. Changes will not retrospectively remove rights that have already accrued or any rights that cannot lawfully be excluded.

Intellectual Property Rights - Our Limited License to You

The Site and Program materials are owned by or licensed to Property With PK and are protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth) and other applicable intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and Program materials for your own personal, non-commercial education.

Unless we give you prior written permission, you must not copy, reproduce, modify, translate, republish, upload, post, transmit, distribute, sell, resell, sublicense, share, commercially exploit, create derivative works from, frame or systematically extract any Site or Program material. You may download or print a reasonable number of copies where we expressly make that function available, provided all copyright and proprietary notices remain intact.

Your Program access is personal to you. You must not share your login details, recordings, templates, documents or other Program resources. Unauthorised sharing may result in suspension or termination of access and may expose you to liability for reasonably incurred losses and enforcement costs, subject to applicable law.

Intellectual Property Rights - Your License to Us

You retain ownership of material you submit to us, including comments, community posts, photographs, videos, reviews, testimonials and project information (User Content).

By submitting User Content, you confirm that you own it or have all permissions required to submit it. You grant Property With PK a worldwide, royalty-free, non-exclusive license to host, store, reproduce, adapt, communicate and display that User Content as reasonably required to operate the Site, deliver the Program, administer our community and provide support.

We will obtain your consent before using your name, image, testimonial or identifiable project results in external advertising or promotional material, unless you have already given that consent through a separate release or submission process. To the extent permitted by the Copyright Act 1968 (Cth), you consent to acts reasonably necessary for these permitted uses that might otherwise infringe your moral rights.

We may moderate, decline to publish or remove User Content where we reasonably consider it unlawful, misleading, infringing, confidential, unsafe, offensive or inconsistent with these Terms or the purpose of the community.

Linking and Third-Party Content

You may link to the Site provided the link does not falsely suggest that we sponsor, endorse or are affiliated with you. You must not frame, embed or reproduce Site content without our prior written permission.

The Site or Program may contain links, referrals, recommendations or information relating to third-party websites, products, services or professionals. These are provided for convenience or general information only. Unless expressly stated otherwise, we do not control, endorse or guarantee any third party or the accuracy, availability, quality or suitability of their products, services or information.

Any dealings between you and a third party are directly between you and that third party. You are responsible for conducting your own enquiries and obtaining appropriate professional advice before engaging or paying any third party.

Educational Purpose and General Information

The Site and Program are educational only. All information provided by Property With PK is general in nature and has been prepared without taking account of your objectives, financial situation, needs, experience, property, project or personal circumstances.

Nothing on the Site or in the Program constitutes personal financial, credit, taxation, accounting, legal, engineering, architectural, building, planning, valuation, real estate, investment or other professional advice. It is not an offer, recommendation or solicitation to acquire or dispose of any financial product, property or investment.

Property With PK is not acting as your financial adviser, credit representative, mortgage broker, solicitor, accountant, real estate agent, builder, building consultant, architect, engineer, certifier or project manager. Property With PK does not hold an Australian Financial Services License and does not provide financial product advice.

Before acting on any information, you must consider whether it is appropriate for your circumstances and obtain independent advice from appropriately qualified and, where required, licensed professionals.

Renovation, Building Work and Approvals

Property With PK does not manage, supervise, inspect, certify or accept responsibility for any property, renovation, building work or project you undertake. Renovation and property investment involve financial, commercial, legal and physical risks.

You are solely responsible for:

• conducting property, title, planning, building, pest, financial and legal due diligence;

• independently checking all estimates, assumptions, measurements, values, budgets, quotations, timeframes and potential returns;

• engaging appropriately qualified, licensed and insured builders, tradespeople, consultants and other professionals;

• checking licenses, registrations, insurance, experience, references, contracts, quotations and the scope of every person you engage;

• obtaining all required council, planning, development, building, strata, heritage and other approvals, permits and consents;

• complying with all laws, building codes, planning controls, licensing requirements, contracts, insurance conditions and work health and safety obligations applying to your State or Territory, property and project; and

• safely identifying, assessing and managing hazardous materials and site risks, including asbestos, lead, mold, structural hazards and services.

Laws, approval pathways, licensing requirements and building standards differ between Australian States, Territories and local government areas and may change. You must verify the current requirements applying to your project and location.

Trades, Professionals and Referrals

Any details, introduction or referral relating to a builder, tradesperson, consultant, supplier or other professional are provided for general information and networking purposes only.

Unless expressly agreed in writing, Property With PK does not act as an agent for you or the referred person and does not supervise, control or guarantee their work, conduct, availability, price, licensing, insurance or suitability. Previous use, a community recommendation or inclusion in a contact list does not replace your own due diligence.

You decide whom to engage and contract with them directly. Any dispute concerning their work, payment or conduct is between you and that person.

Money Partners and Joint Ventures

Any introduction to or information about a potential money partner, joint-venture participant, financier, property or project is provided for general information and networking purposes only.

Property With PK does not assess, vet, endorse, recommend or guarantee any participant, project, opportunity, finance arrangement or investment structure. Any arrangement you enter is at your own risk and on terms independently agreed by the parties.

You must conduct your own due diligence and obtain independent legal, financial, taxation and credit advice before contributing money, entering a joint venture, borrowing, lending, providing security or committing to a project.

No Guarantee of Results

Property With PK does not represent or guarantee that you will purchase a property, complete a renovation or achieve any particular saving, valuation, equity uplift, cash flow, profit, return, borrowing capacity, portfolio growth or other outcome.

Examples, projections, estimates, case studies and testimonials are illustrative only. They are not promises, forecasts or guarantees of your results and should not be regarded as typical or average results.

Your results depend on factors outside our control, including your effort, knowledge, decisions and circumstances; access to finance; the property and scope of work; the conduct and performance of third parties; approvals; defects; market conditions; interest rates; taxes; costs; delays and unforeseen events. You may make no profit and may lose money.

Purchases and Payment

You agree to provide accurate and complete purchase and billing information and to pay all fees and instalments when due. If a payment is declined or overdue, we may suspend Program access while we make reasonable attempts to contact you and resolve the issue. Access may be restored once all overdue amounts and any properly disclosed applicable charges have been paid.

You authorise our payment provider to process payments under the payment option you select. Third-party payment providers may have their own terms and privacy practices.

You must not make purchases for an unlawful, false or fraudulent purpose. If you purchase on behalf of another person or provide their personal information, you confirm that you are authorised to do so and have obtained any required consent.

Refund Policy and Australian Consumer Law

Except where required by the Australian Consumer Law or another applicable law, all sales are final and no refund will be provided, in whole or in part, for:

• a change of mind;

• a change in personal or financial circumstances;

• an inability to obtain finance, a loan or a sufficient deposit;

• an inability to purchase, renovate, refinance or sell a property;

• dissatisfaction with Program content or your own results;

• failure to access, complete or participate in the Program;
  non-attendance at calls or mentoring; or

• another reason personal to you.

You acknowledge that you have reviewed the Program description, inclusions, pricing and these Terms before enrolling and that the Program requires your time, effort, judgement and implementation.

If you are experiencing genuine financial hardship while on a payment plan, you may contact us at least seven days before the next instalment is due to request an extension. Any extension is at our discretion and does not constitute a refund or waiver of the amount owed.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Where permitted by law, our liability for a failure to comply with a consumer guarantee relating to services is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

Lifetime Access and Mentorship

Any reference to lifetime access or lifetime mentorship means access for as long as Success Property Ventures Pty Ltd continues to operate and provide the relevant Program, subject to these Terms.

We may reasonably change the platform, delivery method, schedule, format, presenters, community, resources and inclusions to maintain or improve the Program, respond to operational or legal requirements, or replace unavailable features. We will not use this clause to remove accrued rights or avoid obligations that cannot lawfully be excluded.

Interactive Features and Community Conduct

The Site or Program may include community forums, video calls, comments, messaging and other interactive features. You are responsible for material you post, submit or communicate.

You must not:

• restrict or interfere with another person’s lawful use of the Site or Program;

• impersonate another person or misrepresent your identity or affiliation;

• gain or attempt to gain unauthorised access to any account, system or network;

• post or transmit unlawful, threatening, abusive, defamatory, obscene, discriminatory, misleading or otherwise inappropriate material;

• infringe another person’s intellectual property, privacy, confidentiality or other rights;

• upload malicious code or disrupt the Site, platform or community;

• advertise, solicit, promote or sell products or services without our prior written approval;

• collect or use another member’s personal information for marketing or another unauthorised purpose; or

• share confidential Program or member information outside the Program.

We may reasonably monitor, moderate, remove or refuse content and may warn, suspend or revoke access where a person breaches these Terms or behaves in a disrespectful, unsafe, unlawful or seriously disruptive manner. Where appropriate, we will consider the nature and seriousness of the conduct before acting. No refund is payable for access lawfully terminated because of a serious or repeated breach, except where required by law.

Registration and Passwords

You must provide accurate, current and complete registration information, which may include your name, email address, year of birth, postcode and country. Our collection and handling of personal information is governed by our Privacy Policy and the Privacy Act 1988 (Cth), where applicable.

You are responsible for keeping your login details confidential and for activity occurring through your account. You must notify us promptly at info@propertywithpk.com.au if you become aware of unauthorised access or another security breach.

Website Availability and Security

We use reasonable care in operating the Site and Program platforms but do not guarantee uninterrupted, error-free or virus-free access. Access may be interrupted for maintenance, upgrades, outages, cybersecurity events or circumstances outside our reasonable control.

You are responsible for using appropriate security software, maintaining backups and protecting your own devices, data and accounts.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, the Site, Program and all related information and materials are provided on an as available basis. We do not give any warranty or representation beyond those expressly stated in these Terms or imposed by law.

Nothing in these Terms excludes, restricts or modifies liability that cannot lawfully be excluded, restricted or modified, including liability arising under the Australian Consumer Law.

Subject to the preceding paragraph and to the maximum extent permitted by law:

Property With PK is not liable for indirect, special or consequential loss, loss of opportunity, loss of profit, loss of revenue, loss of anticipated savings or loss arising from the conduct of an independent third party;
Property With PK is not liable for loss caused by information or circumstances outside our reasonable control, your failure to obtain professional advice, or your failure to conduct appropriate due diligence; and
our aggregate liability arising from the Site or Program is limited to the amount you paid us for the relevant product or service giving rise to the claim.

Any limitation applies only to the extent it is fair, reasonable and legally enforceable in the circumstances.

Indemnity

To the maximum extent permitted by law, you indemnify Property With PK against reasonably incurred loss, liability, damage and expense arising directly from your unlawful conduct, material breach of these Terms, infringement of another person’s rights, or User Content you submit.

This indemnity does not apply to the extent that the loss was caused or contributed to by our negligence, unlawful conduct or breach of these Terms, and it does not exclude any right or remedy that cannot lawfully be excluded.

Suspension and Termination

We may suspend or terminate your access where you materially or repeatedly breach these Terms, fail to pay an amount when due, misuse our intellectual property, compromise security, engage in unlawful or seriously inappropriate conduct, or create a material risk to Property With PK or other users.

Where reasonable and appropriate, we will give you notice and an opportunity to remedy the breach. Immediate action may be taken where necessary to protect safety, security, confidential information, intellectual property or legal rights.

Upon termination, your right to access the affected Site or Program materials ends. Provisions concerning intellectual property, payment obligations, disclaimers, liability, indemnities, dispute resolution and accrued rights survive termination.

Copyright Complaints

If you believe material available through the Site infringes your copyright, email info@propertywithpk.com.au with:

your name and contact details;
identification of the copyright work;
identification and location of the allegedly infringing material;
an explanation of your rights in the work and why you believe the use is unauthorised; and
any supporting information.

We may request further information and may remove or restrict access to material while a complaint is assessed under the Copyright Act 1968 (Cth) and other applicable Australian law.

Privacy

We collect, use, disclose and store personal information in accordance with our Privacy Policy and applicable Australian privacy law. By using the Site or enrolling in the Program, you acknowledge that you have reviewed the Privacy Policy.

Complaints and Dispute Resolution

If you have a complaint or dispute, please first contact us at info@propertywithpk.com.au and provide reasonable details. Both parties agree to attempt to resolve the matter in good faith.

If the dispute is not resolved through direct discussions, either party may propose mediation in New South Wales before commencing court proceedings. Nothing in this clause prevents either party from seeking urgent interlocutory relief or exercising a right under the Australian Consumer Law or another applicable law.

Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You and Property With PK submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

Assignment

You must not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations as part of a genuine sale, restructure or transfer of our business, provided the assignment does not reduce any non-excludable rights you hold under applicable law.

Severability and Waiver

If a provision of these Terms is unlawful, void or unenforceable, it will be read down to the extent necessary or, if it cannot be read down, severed. The remaining provisions will continue to operate.

If we do not immediately enforce a right under these Terms, that does not waive the right.

Entire Agreement

These Terms, the Privacy Policy, the Program description and any additional written terms expressly agreed between you and Property With PK constitute the agreement applying to your use of the Site and participation in the Program. If there is an inconsistency, any specific written terms for your purchase prevail to the extent of that inconsistency, subject always to applicable law.
